If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Landamax Limited’s (trading as Lightning Smart) relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.

The term ‘Lightning Smart’ or ‘us’ or ‘we’ refers to the owner of the website , Landamax Limited, a company registered in England, registration number 07755189.  Our registered office is at PO Box 18118, BIRMINGHAM, B29 9FF.  The term ‘you’ refers to the user or viewer of our website or the booker of a coaching session.

  • The content of the pages of this website is for your general information and use only. It is subject to change without notice.
  • If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.
  • This website uses cookies to monitor browsing preferences. If you do allow cookies to be used, then personal information may be stored by us for use by third parties in line with our privacy policy.
  • Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
  • We will not be liable if for any reason our site is unavailable at any time or for any period.

    • Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.
    • You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.
    • If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
    • Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.
    • You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
    • We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

    • Applicable Law: Your use of this website and any dispute arising out of such use of the website is subject to the laws of England and Wales.
    • Variations: We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

Coaching Sessions

  • Conduct of coaching sessions: Coaches are responsible for the conduct of their own sessions and Lightning Smart takes no liability for the conduct or outcome of any coaching session
  • Technical issues or a Coach no show: If a coaching session doesn’t happen due to the non-availability of the coach or technical issues with the Lightning Smart session delivery platform then you will be entitled to a full refund or account credit.
  • Changing the time of a session: Please notify us by email to support@lightningsmart.co.uk if you wish to change the time of your session
    • If requesting a change of time more than 7 days from the session date a credit will be allocated to your account, available to be used as payment against another coaching session
    • If requesting a change of time within 7 days but more than 48 hours from a session date then a 10% deduction will be made to the credit applied
    • It is not possible to request a change of time within 48 hours from a session date and no credit will be offered (see cancellation section)
  • Cancellation: If you change your mind and don’t wish to have a coaching session and would prefer a refund rather than a credit then a full account credit will be given if you email Lightning Smart within 48 hours of your booking being made, so long as the session is at least 7 days in the future from the point of notification
    • Otherwise a refund will be given on cancellation, subject to a 25% administration fee if cancelling more than 48 hours before a session is due, or a 50% administration fee if cancelled within 48 hours of a session time. 

 Complaints

  • Complaints about the conduct of a session:  Your contract for the professional conduct of your coaching session is between you and your chosen coach.  Any complaints about the conduct of the session need to be taken up with the professional association of the coach.  Lightning Smart will inform you of the contact point if you wish to make a complaint so please contact us at support@lightningsmart.co.uk within 24 hours of the coaching session taking place
  • Any other complaints:  Any complaints about the service from Lightning Smart should be notified by email to Support@lightningsmart.co.uk
